Edesur’s intervention is official: what the resolution says

Economy Minister Sergio Massa announced it on Monday “intervention for 180 days” of the Edesur electrical distributor “for the purpose of checking the conformity of the works e of service improvement” which it has to supply in its concession area of ​​the Buenos Aires Metropolitan Area (AMBA). The decision was taken due to the massive and constant power outages, this Tuesday the government formalized the initiative through resolution 307/2023 , published in the Official Gazette.

“The National Electricity Regulatory Agency (ENRE) has ordered the intervention of control and inspection of the EMPRESA DISTRIBUIDORA SUR SOCIEDAD ANÓNIMA (EDESUR SA) for a period of HUNDRED EIGHTY (180) days”, details the text of the resolution .

Moreover, it has also been made official the appointment of Jorge Ferraresi as data controller. The mayor of Avellaneda must supervise and control “the deeds of ordinary administration and disposition connected with the normal provision of the public service of electricity distribution”.

For this reason, the holder “will have the powers to assign the human resources necessary to assist him in the function entrusted”, specifies the document.

Another of the keys to resolution 307/2023 is that it specifies that the designated auditor must submit partial reports to ENRE with a frequency not exceeding TEN (10) days and a final report within TEN (10) days from the completion of his function of inspection and control.

The document which bears the signature of its owner, Walter Martello, also invites the government of the City and the government of the Province of Buenos Aires to “designate, respectively, representatives so that they adhere to the prepared intervention”.

Yesterday evening the Minister of Economy also anticipated the decision to enforce the $2.7 billion in fines required of the company by the state to return to users the service not provided by the company.

“The situations that thousands of Argentines have had to live in the last 15 days can no longer be tolerated”, said the minister in a message from the Microcine del Palacio de Hacienda, in which he was accompanied by the Secretary of Energy, Flavia Royón; the legal and administrative secretary, Ricardo Casal, and the controller of the National Electricity Regulatory Body (ENRE), Walter Martello.

The minister clarified this in his speech “shareholder ownership is not affected” and he remarked that “the State will carry out the effective control of compliance with the contract because a basic public service which must guarantee electrical workers and ordinary citizens cannot be affected by non-compliance by companies”.

“Over the past 15 days we have experienced situations that have affected and hurt us all. Clearly seeing businesses throw away goods, houses without electricity and water throughout the Edesur concession set the agenda,” Massa said in announcing the decision .
