The owners of the dairy farm together with the workers who remained at work during the conflict.
Faced with the dismissal of 26 workers and the impeachment process of 3 union delegates of the Lácteos Vidal company, the Association of Dairy Industry Workers of the Argentine Republic (Atilra) presented a precautionary measure and the case is expected to advance by the end of this week.
“Given the presentation of Atilra employees so that people are not fired or hired to replace them, the court issued a precautionary measure in order not to innovate. This decree was challenged in good time, the court accepted the appeal and decided to transfer the case until Friday, when it will be possible to carry out the defense on the merits and present all the elements we have and that it was not appropriate to present in the appeal. , “explained Eduardo Darriba, labor lawyer of the Firm, referring to the order issued by the judge José Ignacio Ramonet, in charge of the National Labor Court no. 69, who granted an injunction filed by Atilra and established that the defendant company “refrain from innovating in the contracts of the workers who participated legitimate measure of trade union action (strike), having to proceed with the immediate reintegration of the workers concerned “.
For her part, Alejandra Bada, owner of the company, warned her a few days ago while talking with Clarione: “A judge who only heard the union bell signed a precautionary measure that says we cannot fire or hire anyone, that is they want us to close the factory“.
The conflict began in mid-July with the guild’s claim for the reclassification of fourteen factory employees located in the city of Moctezuma, in the western part of Buenos Aires. On 20 July the compulsory conciliation was enacted and the activities in the factory were resumed with a “crisis” operation since, foreseeing new complications with the union, production was not completely reactivated. But on 11 August, with the expiry of the provision, Atilra returned to the field in front of the plant until a few days ago.
Bada reported that the company’s situation is very delicate because in this period they only had to work with 12 of the 46 employees, so they were unable to process the usual volume of milk. “There are a lot of products that we haven’t had in a long time and we couldn’t sell,” she said, clarifying that they have already hired ten new employees to replace those made redundant.
“We fired those who blocked us more than 60 days ago and are colluding with the union to join us. Our priority is the well-being of the kids who are working,” said the entrepreneur, adding: “The relationship with these people is broken. They threatened their teammates, ignored them, so trust was totally lost, “he assured.
Meanwhile, 21 employees of the factory have signed a letter with name, surname and DNI in which they assure him the request was made peacefully and publicly, without blocking, and accuse the company management of rejecting dialogue and resorting to violence to “intimidate” workers. “There was the use and display of firearms to intimidate the comrades by one of the owners; the attack with a delivery van driven by another of the owners, damaged the entrance gate and caused the violent fall of the companions present “, they warn. published on the Atilra page.
Furthermore, from the union they have linked the leadership of the company with an “anti-blockade movement” which they have placed in the same category as other groups such as Federal Revolution. “The criminalization of labor claims is a toxic strategy rooted in Argentina’s far rightwhich, in the present case, finds a link with illegal movements such as the so-called Anti-Bloc Business Movement, Federal Revolution, whose members tried to assassinate our vice president, the Nazi groups and the Pros, “said Atilra in a statement, and added: “We are only workers who claim our constitutionally protected rights Violations by the employer recognized by the company itself“.
For her part, Florencia Arietto, a criminal lawyer of the dairy company, denounced two complaints against the Atilra union. “This has never been a strike. It has always been an extortion block,” she shot. “Atilra always does the same with all the dairies in the country: he wants to make the decisions of the factory and if not he prevents you from working. This has to stop, not only happens to Lácteos Vidal, which is a company that keeps an entire city afloat, like Moctezuma, but it happens systematically to all the other dairy companies in the country “, denounced the lawyer.
