Wiktionary Police Chief Terry McCaffrey was found guilty of sexually assaulting one of his employees.
He has been on enforced leave since being charged in January 2021.
Mr. stared directly. McCaffrey on camera as he listens to Judge J. Elliott Allen’s verdict via the Zoom conference Monday morning, following the trial that took place in March.
The judge pointed out that the victim testified that Mr. McCaffrey tried to comfort her before touching her chest without her consent. She would have told him No. but then they have talked about the work as if nothing had happened .
The victim waited several months before filing a complaint with the Ontario Provincial Police (OPP) in September 2020.
The judge further said that Mr. McCaffrey, who until recently was president of the Ontario Native Chiefs of Police Association, denied the facts persistent and enthusiastic .
The defense says the employee showed up of hatred to the Chief of Police and fiction of sexual assault .
One of the important pieces of evidence in this file is a notepad kept by the victim, in which the attack is mentioned. The defense, who alleged the victim altered the records a few weeks after the incidents, asked an expert on document sequence to testify.
Judge Allen said he found the question innovative, but he believed the victim’s notes showed someone who felt excited and bewildered following a sexual assault.
He also recalled that although the victim repeated and rambled at the time of his testimony, he was unwavering in the essential aspects of his version of the facts .
These are not acts done by someone seeking to file a false complaint, said the judge.
The Chief of Police fake a bad memory
On the defendant’s side, Judge Allen considered that Mr. McCaffrey was evade during his testimony. He said he had a hard time believing the accused not remembered of some circumstances.
Crown prosecutors charged him fake a bad memory .
His sentencing hearing will take place on May 10.
The Chairman of the Wikwemic Police Department Board of Directors is not no comment to share about the decision made or the status of Mr. McCaffrey as an employee, including whether he was on paid leave or not.
