The attempt by one of the truckers ’convoy organizers, Tamara Lich, to appeal her bail conditions reached a milestone on Wednesday, winning a procedural win.
Mrs. Lich’s lawyer, Lawrence Greensponsaid on April 20 that the judge had made some mistakes in imposing certain conditions on his release on bail.
If greenspon wants to make this argument in the Superior Court of Justice of Ontario, but the Crown believes that the law does not allow a Superior Court judge to review the decision of another judge of the same court.
After hearing My arguments greensponJudge Julianne Perfect however, sided with him on Wednesday.
In his decision, he explained that the law requires that no defendant can be denied reasonable bail without reason and that significant restriction on access to a reassessment would be contrary to this right.
An important purpose of bail provisions is to respond to the changing circumstances of cases as they move through the court system.
If greenspon now it is likely to argue that there were errors of law made when Ms Lich received her bail conditions. He is expected to campaign for allowing Ms Lich more access to social media while on bail.
Si Ms. Lich, 49, helped raise millions of dollars to support the convoy of truckers that have been paralyzed in downtown Ottawa for more than three weeks.
He was arrested on Feb. 17 and charged with mischief, inciting others to commit mischief, obstructing police work, inciting others to obstruct police work, of encouraging others to bully and intimidate by obstructing and blocking one or more highways.
