A former Quebec police officer re-convicted of sexual assault

Former police officer Maxime Lehoux was convicted of sexual assault on Thursday at a Quebec City courthouse. This is the second conviction in less than six months for a former officer of the Service de police de la Ville de Québec (SPVQ).

Judge Steve Magnan denied the defendant’s version that his victim, who was 25 years old at the time of the cases, had consented.

This new verdict relates to events that took place on the night of February 2 to 3, 2018. The victim spent the night at a restaurant-bar in Quebec with a friend. After dinner, he met Maxime Lehoux, an acquaintance. The accused was a police officer then SPVQ.

When his friend left, the complainant remained at the establishment before being taken home by Lehoux. He used to live with his parents. The assault occurred in the basement of their residence.

The girl woke up the next day feeling severe pain in her vagina and buttocks. He has no memory of the attack, except for a flash about condoms.

Condemnation

Out of embarrassment, the victim did not tell anyone what had happened. He decided to file a complaint against Maxime Lehoux after learning in the media, in the summer of 2018, that he had been arrested for a similar attack on a co-worker.

At his trial last fall, the former police officer admitted he had sex with the complainant, but insisted the latter consented, denying that he was drunk.

Judge Steve Magnan did not accept his version of the facts, especially about the two elements, the state seems normal of the victim and the preparations for their intercourse, especially the consent of the maiden.

Unreliable or unreliable

In reading his decision, the magistrate raised several contradictions in the testimony of the former police officer, whom he described on several occasions as a nor can it be trusted, nor sincere at also not convincing.

Despite the loss of his memory and some contradictions in the victim’s testimony, which he attributed to his excessive alcohol consumption, the judge indicated that the Court believed his version, which is described as prank at trustworthy.

The Court established more than a reasonable doubt the lack of consent for sexual intercoursesaid Judge Magnan.

Representations on the former police officer’s conviction will be held Sept. 23 in Quebec.

Other Conviction

On December 16, Maxime Lehoux was sentenced to 18 months in prison. He was convicted of sexually assaulting a drunk co -worker at a Christmas party at a Stoneham cottage in 2016.

In the middle of the night, Lehoux, then 25, slipped into the victim’s room, a patroller, to have sex with her.

The maiden was unable to repel her attacker due to her advanced state of intoxication. The notion of victim consent is also at the heart of this first trial.

In addition to the 18-month prison sentence, the judge imposed 2 years probation on him. Maxime Lehoux’s name was also added to the Sex Offenders Registry.
