Tadoussac saw Otherwise dismissed its motion against Croisières AML

Local whale-watching company Tadoussac Otherwise will not be able to advance its legal proceedings against the company Croisières AML, which has been making exclusive use of part of the municipal port since 2017. The Court’s superior judge agreed that and Serge Francoeur AML.

AML Cruises argued that the delays in suing Tadoussac Otherwise were unreasonable.

Tadoussac otherwise took the first legal steps in 2017, but had to abandon them due to lack of financial means.

In 2021, the dispute will be returned to court. Vice-president Tadoussac Otherwise and L’Estuaire captain Florent Desrochers believe it is illegal to grant exclusive rights to municipal property.

Last Friday, Judge Serge Francœur ruled that out the Court does not intend, even considering that it has legal possibility, to use its discretionary power to allow the action of the plaintiffs to proceed, since the resolution and the lease have been known to them since the years.

The attack on a resolution and a contract 5 years after their entry into force was too late.

We can also read in the judgment that the recognized reasonable period of time to fight a resolution and a hire of the kind intervened is usually set at approximately 30 days.

Tadoussac Otherwise reflects its future

Florent Desrochers said he knew the delay in starting procedures was a weak point. However, he said he was disappointed and wanted to have a judge’s answer on the merits of the case.

It was like a big slap was received. It must be said that we are not welcome to work at home.

For now, he said Tadoussac Otherwise will continue to take tourists by boat from the coast and not use the port. This way of doing things is not ideal for the company because the sand can damage the boat’s engine.

Florent Desrochers had to get off and up the footbridge every time he came to the beach.

This judgment also prompted Florent Desrochers to question the future of Tadoussac Otherwise. We live with a lot of frustration and questioning about the futureconfession of the vice president.

We have the impression that the Municipality would have wished that Tadoussac Otherwise would have ceased to exist. Maybe we’ll go with that option.

Peaceful agreement between AML and Tadoussac Otherwise

Tadoussac Autre and Croisières AML agreed a few years ago for the small company to use the municipal wharf to pick up and drop off its passengers. One of the conditions is that the boat Tadoussac Otherwise will not accommodate more than 12 passengers.

Estero must be anchored on the shore. A small footbridge allows passengers to get on the boat without even dipping their feet in the water.

However, due to the breakdown, Tadoussac Otherwise replaced its boat, the Frank Slim, for the Estuary, a new ship that can accommodate 36 passengers.

AML says it wants to find a new common ground

Croisière AML’s vice-president of development and public affairs, Lucie Charland, said she was satisfied and relieved with the judgment.

Ms. Naninindigan. Charland wants AML to go ahead and focus on the tourist season starting, but he insists the hand has been extended to try to work with Tadoussac Otherwise, without revealing more details.

Lucie Charland is looking forward to the upcoming season.

Despite the tensions, then even the disagreement that formed the situation in the village, then even between the organizations, we always wanted to find a constructive solution.

Without obligation, we have reiterated in Tadoussac Otherwise our desire to cooperatevice president’s announcement.

Lucie Charland would like to remind that AML has been in the region for 27 years. The judgment asserted the rights of the AML, he said.

For his part, Tadoussac mayor Richard Therrien, did not want to comment on the file at the moment.
