The first weeks of the incarceration of Brandon Metallic, accused of the double murder that took place in Listuguj, in Gaspésie, in the spring of 2021, were not easy. The man is facing charges related to incidents that occurred while he was detained at the Baie-Comeau detention center.
The man, who is deemed unfit to appear on trial for murder at New Carlisle Courthouse, faces two arson-related charges.
According to the indictment, this fire was caused in his cell intentionally or recklessly on May 29, 2021, two weeks after his arrest. Aside from posing a danger to everyone in the jail, the fire is said to have caused damage to property.
The accused also faces a number of assaults with a weapon or causing bodily harm to a peace officer for incidents that occurred three weeks later, on June 22, 2021, at the same detention center.
Brandon Metallic, allegedly carried, used or threatened to use a weapon or imitation weapon at this time, was not guilty of this number on 25th March.
The individual is accused of causing the deaths of a girl and a man aged twenty years in Listuguj, May 15, 2021. The identities of the two victims are subject to a publication ban.
Mr. Metallic will be held at the Philippe-Pinel National Institute of Forensic Psychiatry in connection with the double homicide committed in the territory of the Aboriginal community in which he lives.
A year later, the question of ability is still there
All cases underway, including those opened in the Baie-Comeau judicial district, cannot proceed until a judge declares that the accused is eligible to appear in justice.
Brandon Metallic will return to New Carlisle Courthouse on June 30. His case was again adjourned for his final court appearance on Friday.
The question of the 29-year-old man’s incapacity has been occupied in Court since last July 2, the date on which he himself requested to undergo a psychiatric evaluation. He then wants the Court to consider the verdict of non-criminal liability.
However, psychiatrists of the National Institute of Forensic Psychiatry Philippe-Pinel and the Court of Quebec instead deemed him unfit to face trial.
After medical treatment that lasted 60 days last fall, Brandon Metallic was declared eligible to face justice in January. However, the Quebec Court again ruled his incompetence following a second review by the Philippe Pinel Institute, conducted in April.
The court ordered on April 14 that he undergo 60-day treatment with antipsychotics, antidepressants and mood stabilizers.
According to specialists, Brandon Metallic is unaware of the seriousness of the allegations against him.
