The Professions Court confirmed the psychiatrist’s temporary radiation for a month, a penalty imposed on him in March 2020 by the disciplinary council of the College of Physicians.

The psychiatrist was convicted in November 2019 of violating the Professional Code for harassment, intimidation and intimidation of staff members of the Régie de l’assurance maladie du Québec (RAMQ).

The psychiatrist noticeably threatened a lawyer from RAMQ to avenge a member of his family, while Régie claimed $ 627,000.

Appealed by Dr. Lessard took this punishment, arguing that it was excessive, unfair and unreasonable and his statements to the staff of RAMQ was held in a private place.

The Tribunal des professions rejected this interpretation. The Court held that Dr. Lessard makes these comments in the use of his profession and not in a private setting, which clearly contradicts the Professional Code..

Judges Marchi, Weitzman and Lebel agree with the Collège des médecins du Québec (CMQ) analysis that the messages between RAMQ and Dr. Lessard [ont été] sent in the context of a dispute relating to professional fees [la psychiatre]as a result of his work as a doctor.

According to them, the appellant’s inappropriate, inappropriate and threatening speech is acts detrimental to the honor and dignity of his or her profession.

Mélanie Lessard was also found guilty of violating the Code of Ethics for Physicians, that it did not dispute on the appeal heard by the Tribunal des professions.

The three judges also denied the psychiatrist’s request to split the temporary radiation to avoid a break in service.

The monthly write-off began on May 31st.

Dr. Mélanie Lessard has held a position at the Sainte-Anne-des-Monts hospital since July 1, 2019.
