Excessive intoxication as a defense: the Trudeau government introduced a bill

The Trudeau government will propose changes to the Criminal Code to comply with a recent Supreme Court decision in which people charged with certain violent crimes could use extreme intoxication as a defense.

The Ministers of Justice, David Lametti, and Women, Marci Ien, will provide more details at a press briefing on Friday afternoon.

The federal government has indicated, by notice in the order paper, that it will introduce a bill on this subject, entitled An Act to amend the Criminal Code (severe voluntary intoxication).

Last month, the land’s highest court ruled in a unanimous ruling that it was unconstitutional to use a section of the Criminal Code that prohibits defending automatism, similar to a state of severe intoxication resulting in loss of self -control. .

Judge Nicholas Kasirer, who wrote the decision, wrote that it violates the Canadian Charter of Rights and Freedoms, because the decision of a person who is drunk does not mean they intend to commit an offense with violence.
