Trial of Dani Alves, the experience that favors him on D-Day: “There are no injuries” and “he is unlikely to have a tendency towards aggression”

This Wednesday, the third and final day of the trial against former footballer Dani Alves for a crime of sexual violence, the court listened to the doctors, forensic experts and psychiatrists who in the early morning of December 31, 2022 assisted the young woman who she reported having been raped by the former Barça defender.

The Brazilian, who will be the last to testify this Wednesday at the Barcelona courthe could be sentenced to between 9 and 12 years in prison.

The witnesses cited were the specialists who assisted the young woman at the Hospital Clinic in Barcelona and who accompanied her in the months following the attack she reported.

“When I arrive, I had a feeling of fear, a certain tension. She seemed like a coherent and polite girl.“, they noted the emotional state of the complainant as soon as she showed up at the hospital.

And they confirmed that he suffers from post-traumatic stress.

“There are no vaginal lesions,” was another aspect the forensic experts said. It’s not the most common but it can happen. Statistics say that (injuries) are more frequent in non-consensual relationships. But in consensual intercourse we found vaginal lesions.”

The report noted no injuries. The complainant’s story does not coincide with the medical examiner’s objective examination“said one of the doctors.

“There are no signs that there was an abusive relationship. It makes me think the relationship wasn’t that traumatic,” another specialist said.

Alves’ defense lawyer wanted to delve into the violence that the girl said she had suffered. “Are those that were described as slaps and hair pulling consistent with what the report indicates?”, asked Inés Guardiola, the third lawyer Alves has changed since she was in preventive detention.

“There is no physical assault except scoliation (a scraped knee),” was the response.

Regarding the traces of genetic material collected in an oral swab of the complainant, the forensic experts replied: “It is not random, it is compatible with that of the (alleged) attacker.”

They clarified, however, that it is generally difficult to isolate a representative amount of DNA in the oral mucosa.

Six drinks in an hour

Two expert psychologists provided their report on Alves’ relationship with alcohol, which is one of the strengths of the former footballer’s defense strategy: trying to demonstrate that Alves acted that morning under the effects of a state of drunkenness .

The testimony of his wife, the model Joana Sanz, collaborated in this direction: “He came home very drunk, he smelled of alcohol. “He crashed into the wardrobe and collapsed on the bed,” the model said in court on the second day of the trial.

“There is no type of problem with alcohol,” said expert psychologists who analyzed possible links between Dani Alves and alcohol addiction.

They pointed out that on the night of December 31, 2022, Alves drank too much “to lose his inhibitions”. AND his cognitive faculties were slightly impaired. Even though she knew what he was doing.

From the ticket of the restaurant where he dined and from the security cameras that recorded him in the Sutton nightclub, the experts recorded that, that evening, Dani Alves dined at a table where They drank five bottles of wine and one of whiskey. And from Sutton’s videos it was possible to deduce that she “drank six glasses of cava in less than an hour”.

In their conclusions, however, they stated: “We find no trait compatible with a violent person”.

A person like Mr. Alves is unlikely to have a tendency towards aggression”they testified.
