Wink to the AFA: Justice has suspended the articles of the mega DNU linked to the creation of sports joint-stock companies

The national team is not playing and there are no Professional Cup matches this Thursday in Argentina, but in AFA there are reasons to celebrate. Justice winked at the institution chaired by Claudio Chiqui Tapia and confirmed the precautionary measure that suspends the articles of the mega DNU, promoted by the Government, which would allow the transformation of civil associations into sports clubs (SAD).

On January 30, federal judge Elpidio Portocarrero Tezanos Pinto, in charge of the Mercedes Federal Court, received the presentation of the Jumping League, affiliated to the Argentine Football Federation through the Federal Council (chaired by Pablo Toviggino), and applied a precautionary measure measure to interrupt its implementation.

The controversy that arose between the world of football and the Decree of Necessity and Urgency (DNU) 70/2023 announced by president Javier Milei in his first weeks in office boils down specifically to articles 335 and 345, which proposed the modification of the statutes. of sports associations, federations and confederations.

Now, it is the Federal Chamber of San Martín that confirms this precautionary measure, underlining that the implementation of said articles “alters the situation of a social impact group such as sports bodies, since it prevents them from developing their associative life.”

Furthermore, it highlights that the debate on these articles does not respect the rules established by the issuing of a DNU: there is no need or urgency, and there is nothing to prevent their parliamentary treatment.

The SAD proposal in Argentine football is an old project promoted by Mauricio Macri and taken up by Javier Milei, turning it into a theme that was included in the campaign when the AFA clubs came out to support Sergio Massa in the run-off.

In these almost one hundred days of the new Government’s mandate, the appointment of Daniele Scioli at the helm of the Nation’s Ministry of Sport, Tourism and the Environment has not been enough to reconcile diametrically opposed positions.

“As soon as I took over this secretary, the first thing I did was call “Chiqui” Tapia, because I have known him for many years. Since I am very frontal, I asked him directly about this problem. He told me that he was not agreed, and that’s fine, it’s their opinion,” Scioli said at a meeting held in the province of Cordoba.

It is known that there are several open fronts in the Casa Rosada and that of the SAD is one of those that generates the greatest resistance. Justice’s decision means a step back and a victory shouted like a goal in the AFA.

The AFA’s reaction: Toviggino’s explosive tweet

Once the sentence of the Federal Chamber of San Martín was announced, Pablo Toviggino spoke on his networks to celebrate the Justice’s decision. Toviggino, head of the Federal Council and strongman of this opposition to the SAD’s entry into football, is the same one who last week crossed paths with Carlos Tevez for a controversial arbitration.

This time, Tapia’s right-hand man and trusted man, underlined with irony the work that the AFA is doing: “I mean, there are them, they are people who do everything right, but everything goes wrong for them. In other words : “There are us, people who do everything wrong, but everything is fine. Why?”, asks the leader.

And he adds, almost in a harangue tone: “We will continue to be a single AFA, one, that of the clubs, that of their managers, a single AFA”.
