STF denies habeas corpus to Robinho and maintains athlete’s arrest for rape

Just this week, the Federal Supreme Court ordered him to serve his sentence for the rape charge in Brazil – the conviction took place in Italy. But the defense filed a request for immediate arrest not to take place.

With the refusal of the preliminary habeas corpus decision, which aimed to avoid the convict’s arrest, the arrest warrant issued on Thursday night must be executed in the early hours of the morning of Friday, 22. There is still the possibility that the former athlete surrenders to authorities during the early hours of the morning to avoid exposure.

In the decision, Fux claimed that the terms alleged by Robinho’s lawyers are not coherent. They stated that it was unconstitutional to serve a sentence in Brazil following a conviction abroad. “The transfer of execution of the sentence is supported by the principle of mutual recognition in criminal matters. Based on this principle, it is even possible to carry out procedural acts in foreign countries, through international cooperation, for example, to hear witnesses by letter rogatory”he declared.

Robinho was accused by an Albanian woman of committing rape in a Milan nightclub in 2013. He was tried and sentenced in Italian court to serve a 9-year prison sentence. However, he was not detained because he was in Brazil. Therefore, the Italian courts requested that the Brazilian courts carry out the sentence. The Superior Court of Justice accepted the request and ordered that he be detained to serve his sentence.
