The judge of guarantees of Lomas de Zamora Javier Maffucci Moore this afternoon rejected the request for the arrest of the Colombian footballer Sebastiano Villawho is accused in one case as the perpetrator of sexual abuse of a young woman, which took place in June last year in a house in a town of Canning.
Maffucci Moore rejected the arrest request that the prosecutor had asked for Vanessa GonzalezHead of Esteban Echeverría’s Functional Education Unit (UFI) 3 Specialized in Gender Violence, which must now consider whether to summon him to an investigative brief.
Among the arguments, the judge held that the testimony of the complainant is not sufficient to stop the player, since – moreover – there are four witnesses who contradict it. Among other testimonies, that of two doctors who did not verify sexual abuse.
In this way the player will remain free, even if he could be summoned for questioning, if the prosecution exercises sufficient elements. In this sense Maffucci Moore Another ordered the prosecutors to continue the investigation and highlighted a substantial omission: Villa’s cell phones have not yet been seized, nor those of the complainant.
In parallel, the magistrate moreover, he did not accept the request for release presented by the defense of the player, represented by Martín Apolo, considering it inadmissible.
Why did they ask for his arrest?
Prosecutor González’s statement was overturned in 59 pages, in which she listed a series of key arguments to request the arrest of Villa, accused of “sexual abuse with carnal access”, a crime which, according to what is exemplified in the third paragraph of art . 119 of the Italian Criminal Code, is punishable by imprisonment from 6 to 15 years, and is not liable to release from prison.
The central basis of the accusation was based on the possible risk of absconding, before the sanction of the crime attributed to him. The judge evaluated it and issued it on the last day he had to do it.
Before the judge ruled, the footballer concentrated, went to La Rioja and started the match against Ferro for the Argentine Cup, which Xeneize won with a goal from the Colombian.
What does the complaint say?
The complaint against the player was filed in writing on 13 May at Esteban Echeverría’s UFI 3 and three days later the complainant ratified it in person at the prosecutor’s office. According to the testimony, the event took place on the night of June 26, 2021 in the village “Venado II” of the city of Canning of Buenos Aires, where the footballer lived, and after a barbecue in which other players of the Xeneize team had participated.
According to the complaint, Villa had consumed “a lot of alcohol” and started berating him for suspecting he liked them or had been with other players on campus. After much discussion, they both left their jobs and went to the footballer’s house along with a security guard and a friend of the player and there, according to what she said, Villa locked her in a room, abused her. sexually and tried to kill her, suffocates.
