After three months of intense negotiations, the Congress of Chile announced on Monday night (12) that it had managed to reach an agreement to start a new process. rewrite the country’s constitution????????
The first proposal to replace Magna Carta from the time of Augusto Pinochet’s dictatorship (1973-1990) was rejected by a popular referendum, and since then politicians of all kinds have been debating the best course to adopt.
“A new path is now being followed to achieve a Constitution born of democracy, a new opportunity to shape the future of our Motherland,” said Senate President Álvaro Elizalde.
Chilean president Gabriel Boric said the congressmen’s agreement “returns to the country the possibility of having a new Constitution that will protect us in the future”.
“We have taken a necessary and hopefully decisive step towards moving towards a new social consensus and a better democracy with more freedoms and more social rights. Once again, we will solve the problems of democracy with more democracy.” stressed Boric, who proved “fit” to “cooperate and support” the process.
The first unsuccessful attempt had a fully community elected Assembly that included independent politicians, civil society representatives and indigenous peoples.
But if the decision to create this House received 80% approval in 2020, its final text was rejected by 62% of voters in September of this year. However, political parties had to take the reins of the process to try to make a new document.
How it will work: Who will write the new text of the constitution will be the “Conselho Constitucional”, a body made up of 50 members elected by the people and 24 experts, 12 from the House of Representatives and 12 from the Senate, appointed by Congress.
The group of experts will have the task of presenting the first draft of the text to the Council, where it will be discussed and will have the right to veto any amendments submitted by the elected members.
The deadlines defined were: creation of the expert commission in January 2023; The election of the founding members will be held in April of the same year. The submission period for the final text to be submitted to the public vote will be six months, and the new referendum was scheduled for 26 November 2023.
