Mexican actor Pablo Lyle was sentenced on Friday in Miami to five years in prison and eight years of probation involuntary manslaughter following a confrontation over a car accident that took place in 2019.
The sentencing comes almost four years after being accused of the death of Juan Ricardo Hernándeza 63-year-old man who ran over on a public road.
Judge Marisa Tinkler Mendez issued the sentence following a more than three-hour hearing in state courts, two months after denying Lyle’s request for a new trial and upholding a guilty verdict by a six-piece jury. members.
The 36-year-old soap opera actor who appeared in the Netflix series “Yankee” and in the movie “Mirreyes Versus Godínez”He faced a maximum sentence of 15 years in prison. His lawyers have requested that he be reduced to one year.
As part of the sentence, the judge also sentenced him to learn conflict resolution and 500 hours of community work. Lyle has 30 days to appeal the judge’s order to a higher court.
Sitting up and wearing a red prison uniform and handcuffs on his wrists, Lyle listened to her sentence. Earlier he had expressed his regret for his actions. “I’m so sorry,” he said in Spanish, addressing the Hernandez family. “It’s the most sincere apology, with the heart.”
After a trial that lasted just over a week, Lyle was convicted in October of manslaughter in the death of Hernández, with whom he got into an altercation over a car crash near the Miami airport in March 2019.
Hernández, of Cuban origin, he was punched by the actor and four days later died in hospital due to a brain injury. The incident was recorded by security cameras.
The magistrate said Lyle made a wrong decision due to his anger and must take responsibility for those actions.
Evidence shows Mr. Lyle’s action was an act of violence, Judge Tinkler Mendez said, after explaining that sentencing the actor was one of the toughest decisions of his judicial career. Nothing will ease the Hernández family’s pain, he said.
The hearing included testimony from Lyle, his brother-in-law, his sister and his wife.
In the case of the testimony presented by Hernández’s representatives, one of his children, his fiancée and his mother, who is 92 and lives in Cuba, spoke. The mother pleaded in a video recorded in advance for justice to be done.
After describing his father as a very cheerful, observant person with good health and principles, Juan Ricardo Hernández Jr. asked the judge to sentence Lyle to a maximum of 15 years. He explained that he had been with him the day before the altercation.
He didn’t want to believe it was him, Hernández’s son said, recalling when he went to the hospital to see his father after hearing the news.
Lyle’s lawyers had asked for the trial and the verdict to be annulled, arguing that there were inconsistencies and that no evidence or witnesses had been admitted that would have shown that the actor acted out of fear for his life and that of his children.
From the outset of the judicial process, the defense emphasized that Lyle acted in self-defense and reiterated this at the sentencing hearing, despite the fact that this charge had already been dismissed by the jury that handed down the verdict and by a higher court. , which was the one that ordered the indictment of the case.
The actor had been in custody since the six-member jury delivered their verdict on Oct. 4, as the judge denied a request to continue under house arrest.
The car crash occurred when Lyle’s brother-in-law was driving the actor, his wife and their two children to the airport.
According to security footage, Hernández stopped his vehicle at a red light, got out, and approached the driver’s window of the car the actor was riding in to claim that his path had been blocked.
Lyle’s brother-in-law got out of the car and argued with Hernandez, but returned to his seat when he saw that his vehicle was moving. Then Lyle, who was in the passenger seat, got out, ran towards Hernández and hit him in the face, according to the videos.
The car with the actor left the place and Hernández remained on the ground, alone. Hours later, the actor was arrested at the Miami airport as he was about to board a plane to Mexico.
