They have sued a tourist company for 5 million: they claim to have forgotten them in the water while diving

A couple has filed a $5 million lawsuit against a Hawaiian tourism company over allegedly a company ship he left them abandoned in the water.

In a complaint released in recent days, the couple claims that in September 2021 what was described in the previous paragraph literally happened, without an iota of exaggeration.

Adrift, accompanied only by themselves and their humble scuba gear, the spouses tried to stay afloat and sent out useless distress signals.

According to Insider, the lawsuit says that Burckle and Webster ended up in deeper and more troubled waters after the alleged abandonment. “They would start to panic and struggle to swim in the ocean conditions. They feared drowning was imminent.”, indicates the litigation.

After a few minutes of battling the current, both washed up on the shore of Lanai “exhausted and dehydrated.” Once there, the woman tried to write the words “SOS” and “Help” in the sand so that any plane passing in the area would see them.

Finally, their salvation would be the local residentswho found them, gave them water, and let them use their phones.

Later, Webster would call Sail Maui and be told, according to the file, that they hadn’t noticed that anyone had gone missing during the tour they had organized hours earlier.

The firm words of the lawyer

Jared Washkowitz, the couple’s attorney, told Insider that the tour company was in disarray. He assured that Sail Maui”he set no limits‘, did not identify a lifeguard or ensure tourists had a peer support system.

The attorney said the tour company made three counts when the couple were in the water and never realized two people were missing until it was too late.

“They spent a lot of time in the water, and if they weren’t young, healthy, athletic people, they would probably have drowned“Washkowitz said.
