He died of heat waiting for the air to settle—his family’s defining decision

Virginia DeSapio He died in August of last year while waiting for the home warranty company to fix his air conditioner. His family claims he died of fatal heat stress. Now, his grandchildren are suing for manslaughter to the responsible company.

The situation of this 82-year-old woman, a resident of Nevada, United States, has not ceased to worsen since her air burst on August 11, 2022.

When the machine stopped working, DeSapio called Fidelity National Home Warranty Co. to take care of the accommodation, but who, according to the complaint, never happened.

According to the complaint, shared by the Washington Post, the company postponed multiple appointments to the point that the woman could no longer take it and one day she was found dead in her home.

DeSapio had paid Fidelity National $635 a year for services, including heat and air conditioning repairs.

one delay after another

After Virginia asked to fix its air, Fidelity National scheduled a meeting for the next day, which was later postponed to August 15. However, that day the lady called one of her nephews, Troy, to wish him a happy birthday and told him that the company would fix the device the next day.

The lawsuit alleges that on the day of the appointment, the company called DeSapio explaining that it would be further delayed because “the technicians investigated the prices“In any case, the repairs would have been before August 22nd.

Meanwhile, temperatures in Las Vegas have surpassed 37 degrees Celsius and the old woman’s house has reached hellish temperatures inside. 48 degrees (120 degrees Fahrenheit).

On the 22nd expected, the woman did not answer the phone calls from her relatives, what caused an alert.

Warned of the situation, a neighbor entered DeSapio’s home and found her dead accompanied by her dog. jessethat she would later die for the same reason as her owner.

Unaware of DeSapio’s death, Fidelity continued to call and email her, advising her there would be further delays. In them, the company informed him that the new repair date would be August 31st.

Finally, on the 31st, the company sent him an email informing him that they had ordered the necessary tools and could take up to 15 days longer to deliver, the lawsuit alleges.

The complaint

Due to the climate and the woman’s age, relatives support him in the lawsuit repairs were expected to begin within 24 hours of DeSapio’s request due to a clause in his contract.

For this, last week the woman’s grandchildren and her lawyer, Christian Morris, filed a wrongful death lawsuit in Clark County District Court against the company for ignoring a request for emergency repairs. “He’s just sweeping what happened to him under the rug,” Morris said.

As if that weren’t enough, on Sept. 5, 26 days after DeSapio filed a complaint and two weeks after she was found dead, Fidelity National emailed DeSapio with the news that repairs to his outdoor unit had been completed.
