The Supreme Court of Michigan, in the United States, rejected this Wednesday an appeal seeking to disqualify former President Donald Trump from that state’s primary elections in 2024 for his role in the invasion of the Capitol three years ago.

He is the last of the a series of judicial appeals raised in several states across the country to prevent Trump from appearing in next year’s primaries, due to his efforts to reverse the loss suffered by Joe Biden in 2020 and the riots in Washington in January 2021.

These calls are based on the 14th Amendment of the US Constitution, which states that officials who swear to uphold the Magna Carta can be barred from holding future office if “participation in an insurrection” is proven.

Michigan’s highest court decided in a brief ruling that it was “unconvinced that the questions presented should be answered by that court.”

Lower courts of Michigan They had closed the case for procedural reasons at the beginning of the trial, confirmed on appeal. This means that the question of whether or not Trump participated in the insurrection was never addressed.

Trump, the Republican frontrunner for 2024, celebrated Michigan’s decision and rejected attempts to disqualify him from the race as “a pathetic maneuver rig elections.”

In a statement published on his social network Truth, the former president (2017-2021) stressed that Michigan “firmly and legitimately denied the desperate attempt” of Democrats to remove him from the ballot in this state, said the mogul who wants return to the White House.

“Colorado is the only state that was a victim of the scheme,” said the former president, who in the past has indicated, without showing evidence, that he was a victim of “election interference.”

The Colorado ruling

Wednesday’s decision contradicts a recent ruling by the Colorado State Supreme Court, which ordered Trump to be barred from the primaries for his role in the riots carried out by his supporters.

His detractors claim he is the former president incited with the previous speeches to prevent the certification of Biden as president, after having denounced, without concrete evidence, alleged fraud. The Republican leader’s charges were later rejected by the US Supreme Court.

The Colorado court froze its ruling until January 4 in anticipation of an expected appeal by Trump’s lawyers to the US Supreme Court.

The Michigan lawsuit was filed in September by Free Speech For People, a democracy advocacy group that also unsuccessfully filed another case against Trump in the state of Minnesota and another in the state of Oregon.

Trump reportedly pressured two election officials in Wayne County, Michigan, not to certify vote totals from the 2020 election, according to a recording of a post-election phone call revealed in a Dec. 22 report by The Detroit News. The former president’s 2024 campaign has neither confirmed nor denied the legitimacy of the registration.

More than 1,100 people have been charged in the January 6 attack on the legislative headquarters, which managed to delay Biden’s certification by several hours, causing, among other things, several damages and the death of a police officer.
