The U.S. Centers for Disease Control and Prevention (CDC) recommended on Tuesday that passengers continue to wear face masks on planes, trains and airports, despite an April 18 court order mandating the use of face masks. It was illegal in the US for 14 months.
The CDC said it bases its recommendation on current conditions and the spread of Covid-19, as well as the protective value of masks.
The Justice Department issued a notice last month that it will appeal the decision, and it has until May 31 to do so. However, the US government did not immediately attempt to take legal action to restore the sanction.
The mandatory mask-wearing period would expire just before midnight on Tuesday, unless the CDC requests an extension of the Transportation Security Administration guideline.
“As a result of the court decision, the mandatory use of masks is no longer in effect and is no longer enforced,” a CDC spokesperson said.
Hours after the April 18 decision, the Biden administration said it would no longer enforce the mandatory use of masks, prompting airlines to allow passengers to no longer wear masks during flights. Passengers now report 10% or less wearing masks on some flights.
