The Court of Instruction 46 of Madrid has opened an investigation against two doctors and against the clinic for the crime of negligent injury. “We consider that there are too many coincidences with fatal consequences. There must be an investigation and they must pay for it,” said the lawyer.
“No breach of medical obligation”
The Ceme clinic expressed regret over the patient’s death, according to the Spanish newspaper. The management has also recalled that a report has been submitted to the investigating court in which it is concluded “that no breach of medical duty by the health professionals who treated the patient can be inferred.”
The patient would have suffered from an exceptional infectious complication called necrotizing fasciitis after plastic surgery, and whose bacteria “is not transmitted to the hospital or nursing staff but comes from the patient’s microbiota.”
In addition, the report specifies that the diagnosis “can be difficult in the first hours or first days of presentation.” When “signs of general deterioration were detected, she was transferred to a more complex center,” the report says.
