TSE chairman Alexandre de Moraes began his tenure in court by pointing out important and true differences with regard to his predecessor, Edson Fachin. Moraes acts more effectively in defending democracy and Electoral Justice.
While Moraes determines the search and seizure of businessmen who defended the coup if former president Luiz Inácio Lula a Silva is elected, he shows his willingness to plot against criminals and defend democracy. Anyone who wants to play scam suffers the consequences.
It is a fact that, like Moraes, Edson Fachin, one of the ministers of the STF, also demonstrated to defend democracy. But it was more in words than actions. Moraes is acting differently: stronger words and attitudes with greater capacity for political expression and more traffic between the military, especially active ones, as demonstrated by his inauguration last week.
Earlier last week, Moraes changed the Supreme Electoral Court’s understanding of restricting the disclosure of candidates’ financial data. During Fachin’s administration, it was widely believed that innovations in the General Data Protection Act would limit the disclosure of information about candidates’ income and assets in the 2022 election.
In a vote cast by Alexandre de Moraes, he argued that this law does not override electoral law that demands transparency from candidates. It was followed and the decision taken under Fachin changed.
Moraes is scheduled to meet today with Defense Minister Paulo Sérgio Nogueira, who is putting undue pressure on Electoral Justice. At this point, it shows that he has more contact with the Armed Forces than Fachin. Moraes’ speech last week leaves no doubt about the defense of the electronic ballot box and the fairness of the electoral process.
Finally, Bolsonaro’s decision to investigate businessmen and putschists is a warning to the president and his civilian and military conspirators. Anyone who thinks Brazil is a banana republic will be punished. Moraes’ performance at the beginning of TSE was the subject of UOL’s podcast “Radar das Eleções”. It is the right name in the right place at the right time.
