Electricity tariffs: the Government has called public hearings to analyze the increases

This Wednesday the government crystallized in the Official Journal the call public hearings to analyze future increases in electricity tariffs.

The invitation to discuss the temporary adjustment of the price of the public service distribution electricity was stipulated for January 26th. Three days later, meanwhile, they will present their concession proposals for the public service transport of electricity.

As established in resolutions 2/2024 and 3/2024 of the National Electricity Regulatory Body (ENRE), which bear the signature of the new auditor of that body, Dario Arruéthe viewing and participation of both procedures, scheduled for 8.30 am, “will be carried out through a digital platform”, while “its progress will be broadcast simultaneously through a streaming platform”.

According to these documents, the hearings will be chaired by Arrué and, jointly and/or alternatively and/or subsequently, by Messrs. María Cristina Tonnelier and Marcelo Ángel Biach, and may designate competent officials to replace them.

Any natural or legal person, public or private, can participate in the so-called “, according to the requirements set out in the art. the Public Hearing Procedure approved with Decree no. 1172/2003, adopted with ENRE Resolution Nº 30/2004”.

Also “the legal persons, organizations or entities concerned through their representatives, who accredit their legal personality through the corresponding legal instrument – duly certified -, admitting the intervention of a single rapporteur on their behalf”.

“To this end, they must register via the web in the corresponding Register of Participants and must satisfy all the requirements established therein. Once the requirements have been completed and validated by the organization, the registration certificate will be sent to the declared email address”, reads the Resolutions.

In both cases, participant registration will be enabled from 00:00 on 8 January to 23:59 on 23 January.

The legislation clarifies to companies that, in addition to presenting their tariff adjustment proposal, They must detail “the investment plan to be carried out during the year 2024.”

The first appointment is reserved for Edenor and Edesur. In the second, the companies involved will be Transener, Transba, Transpa, Transco, Transnea, Transnoa, Distrocuyo and Epen.

Just over a week after taking office, Javier Milei declared a state of emergency “for the electricity generation, transportation and distribution segments under federal jurisdiction, as well as for the transportation and distribution of natural gas.” Furthermore, he ordered the intervention of the regulatory bodies of both services.

It was through the decree of necessity and urgency (DNU) 55/2023, with which it instructed the Ministry of Energy of the Nation to establish the mechanisms for the “sanction of prices in conditions of competition and free access, maintain in terms of real income levels and cover investment needs, to ensure the continuous provision of public transport and distribution services of electricity and natural gas in adequate technical and economic conditions for suppliers and users of all categories.

It also determined the start of the tariff review and established that the entry into force of the resulting tariff tables cannot exceed 31 December 2024.
