Harsh judicial setback for an SME blocked by the union: “They hit the person towing the car in the head”

The National Labor Appeals Chamber rejected all the appeals and complaints that the owner of the Lácteos Vidal company, Alejandra Bada Vazquez, and the deputy Florencia Arieto had presented against the judge in the case investigating the blockade of an industrial plant by part of the Atilra union and the consequent dismissal of workers, due to various resolutions unfavorable to the company.

“I’m sorry because obviously They don’t know what it means to keep a company alive.“They don’t know how much it costs to produce, how much it costs to move forward, acquire customers, produce, try to export, try to grow”, complained Bada Vazquez when asked by Rural Clarin.

Lacteos Vidal had challenged the magistrate’s resolutions which ordered compliance with the art reinstatement of workers dismissed without reasonthe fines for ignoring judicial resolutions and the embargoes produced by the failure to pay Atilra workers with the related economic sanctions.

He had also challenged the Camaristas and presented complaints and appeals. The National Chamber did not accept any of these requests.

“With these failures They hit the heads of us who drive cars, of us who pay taxes, to us who are trying to expand the workforce and provide more work, to us who are trying to launch a new production line, to us who are betting on the country”, added the entrepreneur, and then addressed the union directly: “I know Atilra is cruel to us because they couldn’t untie us, because we did not give in to the forcing of the blockade. When they kidnapped my factory we didn’t give in to extortion, so they want to take revenge because they didn’t manage to create the lazy people’s cooperative. The employees and we, the family, free ourselves from the mafia syndicate from Atilra to Lácteos Vidal, and I understand that at the end of the road there will be justice. We have a clear conscience, both the family and those who continued to work, as well as the new employees. We are working well. I trust that there will be justice at the end of the road.”

The background of the case

On August 16, 2022, at 5 am, Atilra started a union protest in front of the Lácteos Vidal factory at 4995 Tinogasta street, in the city of Buenos Aires, which included pressure and threats to workers of the factory who wanted to come in to work. The conflict escalated with union blockades of the company’s factory located in the town of Moctezuma, western Buenos Aires, and resulted in the dismissal of 26 workers.

Then there was a precautionary measure against these dismissals and the jurisdiction of the case. Alejandra Bada Vázquez, owner of the company, appeared as plaintiff, with the legal representation of the lawyer. María Florencia Arietto.
