The oppositions at the Palais Bourbon extended this Thursday the possibility of electronically rescinding a subscription far beyond the initial project, extending it to all contracts while the Government wanted to limit the measure to those signed online.
This modification was obtained by a conjunction of the votes of the RN, LR and the left-wing alliance Nupes, against the government’s opinion, during the examination at first reading of the purchasing power bill. Article 7 of the text provided that contracts concluded online could be terminated in the same way, with the professionals in charge of configuring an electronic functionality that would allow it.
More dans une Assemblée où le camp présidentiel n’a plus qu’una mayorité relative, les deputés d’opposition sont parvenus à faire passer deux amendements identiques de LR et LFI, étendant cette procédure à all les contrats d’abonnement, conclus en ligne or not. Facing a very close vote by a show of hands, the president of the session, Hélène Laporte (RN), took a “sit or stand” vote to better count.
The government deplores the additional “costs” for companies
Deputy Carlos Martens Bilongo (LFI) praised a “unique solution”, which has “the merit of simplicity”. Dino Cinieri (LR) also welcomed a “major simplification measure”. The Delegate Minister for Commerce, Olivia Grégoire, estimated that such an extension of the system “would impose costs on all economic actors that offer subscriptions”, including artisans or SMEs that often do not have a website that allows online termination.
The deputies also approved article 8 of the text, which aims to force those who offer the subscription of insurance contracts electronically, to provide for the termination by the same means. The deadline for the entry into force of these measures has been postponed for six months – from February 1 to August 1, 2023 – to take into account their “significant impact, thanks to the modifications of the LR, this time supported by the Government “.
By an amendment by Eric Bothorel (Renaissance), the deputies limited the scope of a measure voted in committee that reduces the costs of terminating telephone or Internet contracts. For contracts of more than one year broken before the first twelve months, the device carried by LR Julien Dive was intended to eliminate the remaining 25% of the costs of the second year.
The amendment excludes bundled phone and subscription offers from the measure. Eric Bothorel says that he wants to prevent operators from increasing the price of the package or the terminal, which long-term commitments serve to amortize. LFI accused the majority of accepting an argument from the telephone operators.
