Jacob Hoggard’s defense argued Wednesday at his client’s trial that the woman who accused him of rape was actually trying to blackmail him into apologizing to him after rough sex in 2016 in Toronto.
The 37-year-old musician was accused of inappropriate sexual intercourse with a minor and sexual assault causing harm against both the teenager and the adult in question two days after testifying his litigation.
The actress ’lawyer, Megan Savard, was ruthless and more aggressive than the day before against the 29-year-old woman whose identity was protected by the publication ban.
Me Savard accused him of making up an entire story to gain the jury’s sympathy about a brief 30 -second phone call he made to the accused two days after the meeting on November 22, 2016, because he wanted to apologize and remind him. that he raped her.
The complainant admitted at the witness stand on Tuesday that they agreed to sleep together before arriving by train in the metropolis, but he did not know that the actress was fond of rough sex. He said it didn’t matter to him after their communications.
The singer’s defense, who however made sure their sexual relationships were agreeable, seriously disputed the content of the woman’s statements on the phone.
A compromise call
So he heard the appeal in court, which actually lasted 15 minutes and where we heard the plaintiff apologize from the musician for being aggressive in bed with him in a hotel room in Toronto.
He would never utter the word over the phone rape as he did in a text message before the call.
We also hear the singer calmly talking to him, explaining that he was surprised by the text in question and where it addressed him about their meeting at the hotel.
He stands for that [s]our message came from and that he thought they preferred good time together.
Not exacthe replies, saying that he has been ill since their meeting.
The woman explained to him the bad feeling that she was embarrassed, because she needed to consult a doctor for genital laceration.
The defense tells him that eventually he will no longer need stitches, because he has no laceration.
He admitted in the affirmation that he lied to Jacob Hoggard during the call about the stitches and considered calling a lawyer to force him to apologize.
I try to admit to him what he did to me and acknowledge the seriousness of the damage he has caused me.he says.
He also confessed that he believed he was working at a law firm at the time whose sole purpose was to intimidate him, but that is not what happened.
Allegations of revenge
When the complainant heard his voice on the phone again, the complainant cut himself twice, full of emotion. The judge suggested he postpone the hearing to continue, without success.
Between the two audio tape delays, the complainant explained that in fact he did not quite remember the content of this call, as he had put himself in survival to forget what had happened to him.
The woman also denies Me Savard’s allegations that she was taking revenge on her client, that she was threatening him with the service of a lawyer and that he would sue her in the public plaza for what he had inflicted on her, in particular. for anal rape.
You scare him, because a rock star is no longer interested in you.the lawyer asked. The complainant responded negatively and rejected the idea that Jacob Hoggard had abandoned her for another woman.
Repartee of the singer
We can’t hear Jacob Hoggard apologize on the phone. On the contrary, hearing the annoyed woman, he worries about her health, because he says he values her.
He wants to end the conversation, however, because his phone batteries are dead and he’s with a friend going through an immediate family situation.
The woman on the phone told him that she did not believe in it and that she had carefully chosen her words to describe what had happened between them to protect herself against a possible lawsuit.
He also admitted in court that he had indeed contacted Jacob Hoggard’s wife back then on Instagram (they were not yet married, editor’s note), to ask him if the singer had subjected him to the same thing.
He confessed to me that he had been violent with another woman, but not with her, and suggested that I go to the police and see a doctor in case he gave me herpes.he says.
The defense cited the plaintiff’s statement at the police station in March 2018 where the singer’s wife simply told him that he had not been kind to some women.
Me Savard accuses him that he seeks to control his client, because it is rich and famous and that is the real reason why he apologizes to him. This is wronghe replied.
CBC television interview
The lawyer then attacked the complainant about an interview with the CBC he provided on condition of anonymity. You used this platform to denounce my television clienthe says.
The woman replied that she wanted Jacob Hoggard to answer for her actions and that she just wanted to protect the other woman from a man she called a sexual predator.
She also told the jury the other day that she begged him to stop when it raped her in bed.
However, in the excerpt from the CBC interview that Me Savard showed in court, we heard the plaintiff instead of telling the journalist that he said nothing to the singer, because he did not know what to tell her.
The woman at the bar assured that we would hear her later in the course of the interview saying that she had indeed told him to stop hurting her.
He also admitted that he called the event organizers anonymously. Our day in Ottawa to warn them that he had been attacked by one of the participants in the show without naming him.
He further rejects the idea that he seeks, through this interview, to be the leader of the movement #Me too as promised by the CBC reporter.
He even said he doesn’t remember him celebrating at an Ottawa restaurant the artist’s public opprobrium following the report’s broadcast on Feb. 25, 2018.
If I said this, it would certainly not be a celebrationhe said laughing.
The complainant states that he also did not tell his friend B. that he had found the singer. amazing after he kissed her without warning at the beginning of their meeting at the hotel when he said earlier in his testimony that he had found her rude.
Me Savard also wonders at the fact that the complainant stayed at the hotel after this unsolicited kiss to have sex despite everything instead of leaving the hotel when her client even told her that nothing had happened to her. he was forced to stay in his room.
The way he kissed you before you pushed him away is aggression on its own, don’t you know that?the lawyer asked. No, I didn’t know that thenhe replied.
The cross-examination will end on Friday. Thursday is reserved for controversial issues that have emerged over the past two days of oral argument.
