The New Brunswick Court of Appeal upheld the court’s decision to refuse to suspend the ban on the sale of flavored vaping products.
Beginning Sept. 1, 2021, the province will no longer allow the sale of vaping -flavored products other than tobacco -flavored products.
One business and five individuals want the ban lifted pending a decision on the legal challenge to the proposal.
They argued that vaping businesses suffered financially from this ban. According to them, if there is no ability to smoke flavored products, consumers will revert to their smoking habit, which can pose a greater threat to their health.
In its decision in March, the Court of Queen’s Bench recalled that the government’s goal is to protect the health of the population, specifically the health of young people.
In his one -line judgment, Justice Brad Green of the Court of Appeal simply wrote that the motion to appeal the decision was denied.
No date has yet been set for challenging the constitutional ban.
