Bill 34: expanded access to cheap legal advice in Quebec

Access to low-cost, or even free, legal advice should be facilitated once Bill 34, filed Tuesday by Quebec Minister of Justice Simon Jolin-Barrette, is adopted.

This law will make it possible to obtain legal opinions and advice, and therefore not only information, from non-profit organizations (NPOs), imagine legal information clinics located in the university environment, at the Barreau du Québec clinic or at local justice centers.

Professional advice can be provided by either lawyers or notaries. If necessary, the lawyers consulted will also represent their clients in court.

It aims to thwart the growing trend that people with little means represent themselves in court, even if they do not know their rights, thus exposing themselves to the failure to achieve justice.

More and more Quebecers are choosing to represent themselves before the courts when they are faced with legal problems, because they cannot afford to retain the services of a lawyer. However, and you can quite imagine, many of them would prefer to be accompanied and advised by a legal professional, a lawyer or a notary if they have easier access to it.

Under this law, Quebec will also allow 1,400 retired attorneys to provide inexpensive or free advice, in full or part-time, through such organizations.

Mr. Jolin-Barrette called his bill significant progress in access to justiceadded that the idea of ​​expanding the possibility of obtaining legal services without self -harm is a consensus, in both legal and political circles.

He said he hoped, in this context, that Bill 34 would be passed quickly, by the end of the June session, without too much obstruction from opposition parties.

The initiative was immediately accepted by the President of Quebec, Catherine Claveau, and the President of the Chamber of Notaries, Hélène Potvin, who was present at the press conference.

The bill would give these two authorities the responsibility to regulate this professional practice within non-profit organizations.
