Judge Navarro, in charge of the Barcelona court, understands that there is a serious risk of flight by the Brazilian, due to “serious indications of crime”. How do they support that ruling? “For the economic capacity” of the Brazilian “which would allow him to leave Spain at any moment”.

“We exclude that the alternative measures to pre-trial detention proposed by the defense are sufficient to neutralize the risk of absconding which we have defined as high”, replied the Court of Barcelona.

The former Barca player must continue to be detained while the investigation into the sexual assault complaint continues despite having accepted some precautionary measures, such as the delivery of a large sum of money, his passport, the use of an electronic anklet marked the location and appearing every few days in court.

According to the Cuatro al día program on Spanish TV, since learning that he will have to await trial at the Brians 2 detention center, the player “hasn’t even left his cell to eat”. Furthermore, Alves “shows himself overwhelmed by the bets made by his companions on whether or not he will be released from prison”.

Despite what has been established, the athlete’s defense will continue to try to overturn the decision.

The court’s response

The court concluded that Alves is a flight risk and must remain in jail during the investigation. The footballer was provisionally arrested in January after being accused of sexually assaulting a woman in a nightclub on December 30. His statements about it were changing. At the time, he denied the allegations and claimed the sex with the complainant had been consensual.

Then a judge ordered his entry into prison without bail after analyzing the preliminary investigations by the authorities and taking a statement from Alves, the alleged victim and other witnesses.

The court concluded that these measures would not have been sufficient to prevent the footballer from attempting to escape, as he faces a sentence of several years in prison if convicted. He also ruled that there was considerable evidence that a crime may have been committed and that Alves’ luck would have facilitated his escape regardless of the amount set in bail. The court said that nothing would prevent Alves from leaving Spain without papers and arriving in his country, that he would not hand him over to Spain even if there were international arrest or extradition warrants.

Brazil does not extradite its citizens when they are convicted in other countries. This is the case of another former Brazilian footballer, Robinho, sentenced to nine years in prison for raping a young woman in Italy, a sentence confirmed last year by an important Italian court, but he is still free in Brazil. Alves, 39, can appeal again while the court decides whether to schedule a trial. Under Spain’s law on sexual consent passed last year, sexual assault encompasses a wide range of crimes, from online abuse to groping or rape, with different penalties depending on the case. A violation can carry a maximum penalty of 15 years in prison. Alves won 42 titles in his career, including the Champions League three times with Barcelona and the Copa América twice with Brazil. Last year he played his third World Cup in Qatar.
