The start of Sebastián Villa’s trial for alleged injuries and threats to his ex-partner now has a new date

Although the defense of sebastian villa consider that “there are no elements to go to trial”, the Colombian footballer will be subjected to one, accused of injuries and threats that his ex-partner allegedly suffered Daniela Cortes in 2020, in the house they shared in the city of Canning, Buenos Aires. It is a crime that carries a penalty of up to six years in prison.

The debate will be entrusted to the Penitentiary Court 2 of Lomas de Zamora, charged to Claudia Dávalos, who has set the hearings for the 17th, 18th and 19th of next month. Initially the trial was to take place between 19 and 21 September, but Villa’s defense, led by lawyer Martín Apolo, requested a new psychological evaluation for the complainant and Judge Dávalos decided to postpone the start of the trial.

The trial will focus on the events that took place on April 27, 2020, in the house shared by Villa and his ex, in the private Saint Thomas district of Canning, where he lived before moving to the country estate “Venado II”, where the second episode of gender-based violence allegedly occurred in June 2021 for which the attacker was reported, by another woman, for sexual abuse.

As part of that first complaint, Cortés disseminated images through social networks, after which a case was opened in the Esteban Echeverría 3 prosecutor’s office, which specializes in gender-based violence. In that video, images of the visibly beaten woman were observed, while the complainant recounted violent events she experienced next to the footballer, whom she described as “a rapist, both physical and psychological”.

“We believe that there are not even elements to go to trial”, estimated Villa’s defense attorney who had requested the psychological evaluation of Cortés, who lives in Medellín. The lawyer went to that Colombian city to verify the evidence, but the complainant did not appear, according to the Télam agency.

In June 2021, the Criminal Chamber of Lomas de Zamora confirmed the elevation of this case to trial at the request of the guarantee judge of that district Javier Maffucci Moore, the same one who intervenes in the second case of gender violence involving the footballer. Villa will be tried for the crimes of “minor injuries aggravated by the constraint and for mediation of gender-based violence and coercive threats”.

The second episode was reported by a 26-year-old girl on May 13, 2022 in front of the same prosecutor who, while asking for Villa’s immediate arrest, Judge Maffucci Moore rejected the request and suggested further investigations.

Regarding this file, the lawyer Apolo explained to Telam that various means of proof have yet to be produced, including psychological reports on the complainant and evacuation summons from the investigation of the footballer, who pleaded not guilty.

After being investigated for the crime of “sexual abuse with carnal access” – which provides for up to 15 years in prison – between October and November Villa also underwent a psychological report which, according to his defense lawyer, revealed that the ‘attacker “has no characteristics compatible with the fact that he is accused”.
