The Barcelona Public Prosecutor’s Office filed an appeal against the provisional release of former player Daniel Alves, convicted of rape
Last Friday, the 22nd, the Public Ministry of Spain filed an appeal against the provisional release of Daniel Alves. Barcelona prosecutors reiterate to the Spanish courts that the player can flee if the benefit is granted. So far, the bail of one million euros – equivalent to R$5.3 million – has not yet been paid by the athlete, who is expected to spend the weekend in prison.
In February this year, Daniel Alves was sentenced to a sentence of 4 years and 6 months in prison for a rape committed in a nightclub in Barcelona, in the early hours of December 31, 2022. After the trial, the athlete’s defense filed a request for provisional release, which was accepted by the Spanish Court on bail of one million euros – approximately R$5.3 million.
According to the Spanish Court, the former Brazilian national team player’s request for freedom was accepted because his passports were confiscated, making it impossible for him to escape from the European country. Furthermore, it was determined that Daniel is prohibited from approaching the victim, including her workplace or any other place frequented by her, and will need to appear in Provincial Court weekly – or as often as requested.
Daniel Alves had five requests for provisional release denied by the courts even before his conviction, citing risk of escape, destruction of evidence or recidivism as reasons for refusal.
