The Senate of Tennessee, United States, approved it Wednesday 20 unanimously a bill which will force a drunk driver convicted of murder on a parent or guardian to pay child support for the victim.

The bill was passed unanimously in the Tennessee House of Representatives earlier this year.

“Under this bill, if the defendant was convicted of vehicular manslaughter due to intoxication or aggravated vehicular manslaughter and the victim of the crime is the parent of a minor child, then the sentencing court the defendant must be ordered to pay restitution in the form of child support to each child of the victim until each child reaches the age of 18“says the summary of the bill.

The reasonable amount of child support will be based on the child’s financial needs, the surviving parent’s or the State’s financial resources, and the standard of living to which the child is accustomed, the bill says.

If the offender is incarcerated, they will have up to a year after release to pay the required amount, according to the bill.

The bill was amended from “Bentley’s Law” to “Ethan, Hailey and Bentley’s Law”, all children of victims died in drunk driving accidents.

The origin of the law

The project is called “Ethan, Hailey and Bentley Law” in honor of the children of Nicholas Galinger, a 38-year-old police officer from Chattanooga (southeast Tennessee) who He was run over more than three years ago by a drunk driver.

Ethan and Hailey are the surviving children of the police officer, and Bentley is the granddaughter of Cecilia Williams. He drafted the bill along with several representatives of the legislature, which prompted the murder of his son and his wife at the hands of a drunk driver in April 2021.
