The US Justice Department on Monday asked an appeals court to stay the sentence of a Texas federal judge. which would ban a widely used abortion pill.
“The district court’s extraordinary and unprecedented order should be stayed pending an appeal,” the department said in a court filing.
Judge Matthew Kacsmaryk reversed the Food and Drug Administration’s (FDA) approval on Friday. of mifepristonewhich is used for more than half of the abortions performed each year in the United States.
“If enacted, that court’s ruling would frustrate the FDA’s scientific judgment e It would seriously harm women.”the Justice Department said in its appeal.
“This harm would be felt across the country, since mifepristone is legal for use in all states,” he said.
The Justice Department has asked the U.S. Court of Appeals for the Fifth Circuit to stay Judge Kacsmaryk’s order pending a full appeal. It is thought likely that the case will eventually reach the Supreme Court.
