A Louisiana federal judge on Friday prevented the Joe Biden administration from removing a health measure implemented by the Trump administration during the pandemic to deport without delay migrants crossing land borders without visas of the United States.
Authorities want to lift on May 23 this so -called device Title 42very controversial, as it notably prevents asylum seekers from formulating their request, but the Republican governors of the 24 states that oppose it have taken legal action.
The tribunal concluded that the plaintiff met the conditions to obtain its temporary retention, Judge Robert wrote summerhays in its decision on Friday.
Biden to appeal
The administration disagreed with the court’s decision and the Justice Department announced it would appealsaid in a press release that Karine Jean-Pierre, spokeswoman for the executive, specified interim, the proposal Title 42 will continue to be applied.
the Title 42 was a public health measure adopted in 1893 to protect the United States against the many epidemics of cholera and yellow fever occurring at that time. It has rarely been implemented since then.
In March 2020, the government of former President Donald Trump activated this health system to expel without delay migrants without residence permits arrested at land borders.
This measure is immediate and does not allow legal recourse, even for those who wish to file an asylum application.
Rare exceptions are given; for certain nationalities such as Ukrainians, since Russia’s invasion of their country, or for unaccompanied minors.
A disturbing decision NGO
Human rights activists fear the continuation of Title 42which according to them translates into an increase in attempts to illegally cross the Mexican border, with numerous injuries and deaths as a result.
The unfortunate decision says the government can suspend asylum claims without notice, but cannot restore a normal immigration process without going through a long and complicated process.reacted toAFP Aaron Reichlin-Melnick, expert onNGO American Immigration Council.
He believes this the absurd decision will continue to harm asylum seekers and cause chaos at the border including Mexico.
A total of 557 deaths were recorded at the border in 2021, by far the deadliest year since statistics began in 1998.
Since the measure took effect in 2020, U.S. authorities have used it more than 1.8 million times. According to experts, this does not necessarily correspond to the number of people deported, as some migrants make multiple attempts and are caught several times.
The Centers for Disease Prevention and Control (CDC) published a press release in April in favor of removing this measure, considering the current pandemic situation and the methods available to treat cases of contamination is allowed it.
