Apocalyptic images of bodies lying in the mud amid crooked tanks, burning walls and shattered trees in Bucha and other cities in Ukraine speak of the brutality of the war started by Vladimir Putin. The certainty that more horrors, many more, will be exposed with the departure of Russian troops, it cries out of responsibility.
President Joe Biden called for trial on war crimes and President Emmanuel Macron of France declared that there were “clear” indications of war crimes. Human Rights Watch reported documented cases of rape and summary executions. Ukrainian and international investigators have already begun collecting evidence and interviewing witnesses. It is necessary that such work be done promptly and carefully.
It may seem too legal to analyze evidence or examine witnesses as countless civilians dig into their homes hoping against the hope that Russian shells don’t hit their building. The very idea that war could have rules, with proper means to inflict death and destruction on an enemy, is difficult to understand, and to persecute commanders. carries the risk of making it seem like the justice of success.
For at least 75 years, the international community has made a real but incomplete effort to define wars of unprovoked aggression as crimes in themselves. In the words of the Nuremberg tribunal: “The initiation of a war of aggression, therefore, is not merely an international crime; is the highest international crime which differs only from other war crimes in that it contains in itself the accumulated evil of the whole ”.
