A group of elected congressmen wants to propose a law that would provide federal protection to married same-sex couples amid fears that the Supreme Court will reverse legal recognition of these unions.
The “Respect Marriage Act,” supported by many elected Democrats and a Republican senator, also aims to repeal previous legislation that defined marriage as the union between a man and a woman.
“This Court can attack other fundamental rights”
“Three weeks ago, a conservative majority on the Supreme Court not only overturned Roe v. Wade, ending 50 years of case law, but sent a signal that other rights, like same-sex marriage, could follow.” Democratic Rep. Jerry Nadler said in a statement.
“Since this Court can target other fundamental rights, we cannot sit idly by while the hard-won gains of the equality movement are systematically reversed,” he added.
On June 24, the United States Supreme Court reversed its landmark “Roe v. Wade” decision, which since 1973 guaranteed the right of American women to have abortions, raising fears that other landmark decisions, such as the one on same-sex marriage, reproduce. be questioned legally at the national level since 2015.
a warning sign
In 2013, the high court struck down part of the Marriage Act, called the Defense of Marriage Act, that stripped gay married couples of federal rights, but the law still exists, and the new law seeks to correct it.
The “Respect for Marriage Law” stipulates that “for federal law, a person is considered married if the marriage was validated in the state where it was celebrated.”
“This gives same-sex couples and interracial couples an additional guarantee that they will be able to continue to enjoy similar treatment under federal law as all other married couples, as required by the Constitution,” a statement said.
