The sentence explained that the Plenary Chamber of the Court indicated that “sport fishing is an activity that violates the principle of precaution and prohibition of animal abuseand therefore, should be excluded from the legal system.

The Court’s decision then indicated that the mandate to protect animals stems from “the principles of ecological constitution, the social duty of property and human dignity; and pointed out that, in this context, the Legislature and the Court treated the animals as creatures“.

The high court ruled that though “There is no consensus on whether fish are sentient beings”the fact is that due to the principle of precaution, State intervention is necessary to prevent environmental degradation.

The proposal adds that although it is not possible to define “with absolute certainty the harmful consequences of sport fishing, in terms of the principles of animal protection and welfare, or the impact and degradation of hydrobiological resources, there is an associated scientific information that requires prevention. harmful effects on these creatures and their environment “, so” the exclusion of activity should be preferred. “

The Constitutional Court concluded, however, that Artisanal, industrial, subsistence, scientific, control or promotion of fishing may continue to existbut not sports.

Sport fishing consists of taking animals, whether in rivers, seas, lagoons or dams, and releasing them again.. Due to the orographic diversity in Colombia, there are several areas where it thrives, especially in the reservoirs of the departments of Cundinamarca, Cauca and Antioquia.

However, one of the best places in the world for fishing is Bahía Solano, in the department of Chocó.

This decision is in line with the one adopted in February 2019 when the Constitutional Court banned sport hunting in the country because it was contrary to the protection of the environment and animals.
